Terms of Service

Please read these Terms of Service carefully before using the InnerSpace mobile application ("the App"). By downloading, installing, or using the App you agree to be bound by these terms. If you do not agree, do not use the App.

1. Use of the App

InnerSpace is a personal wellness application providing guided audio sessions, ambient soundscapes, affirmations, private journaling, and AI-assisted tools. You may use the App for personal, non-commercial purposes only.

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to any part of the App or its infrastructure
• Use the App to harass, harm, or impersonate any person
• Use automated tools, bots, or scripts to access or interact with the App

2. Intellectual Property

This includes, but is not limited to:

• All audio recordings, narrations, ambient soundscapes, binaural frequencies, and music
• All visual design, user interface layouts, colour schemes, typography, and motion design
• All written content including session descriptions, affirmation scripts, and in-app copy
• The InnerSpace name, logo, branding, and trade dress
• The underlying software, source code, algorithms, and architecture of the App
• The concept, structure, and design methodology of the InnerSpace experience

You may not, without prior written permission from InnerSpace Studio:

• Copy, reproduce, distribute, or republish any content from the App in any form
• Modify, adapt, translate, or create derivative works based on the App or its content
• Decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of the App
• Scrape, extract, or systematically download audio, visual, or written content from the App
• Build a competing product or service that replicates the design, features, or experience of InnerSpace
• Use the InnerSpace name, logo, or branding in any way that implies endorsement or affiliation
• Record or capture audio played through the App for redistribution or commercial use

Any unauthorised use of InnerSpace intellectual property may result in legal action including claims for damages and injunctive relief.

3. User-Imported Content

InnerSpace allows you to import your own audio files ("User Content") onto your device for personal playback through the App. You retain full ownership of any User Content you import.

By importing User Content you confirm that:

• You own the content or have the legal right to use it
• Your use of the content does not infringe the intellectual property rights of any third party
• You will not use the App to circumvent DRM protections or reproduce copyrighted material without authorisation

InnerSpace does not access, transmit, or claim any ownership over User Content. All imported files are stored locally on your device only. See our Privacy Policy for full details.

4. Subscriptions & Billing

InnerSpace offers optional premium subscriptions (monthly, annual, and lifetime) that unlock full access to all content. Subscriptions are billed through your Apple App Store or Google Play account. Payment is charged at confirmation of purchase.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your device's account settings at any time. No refunds are provided for partial subscription periods.

5. Free Trial

A free trial may be offered for new subscribers. If you do not cancel before the trial ends, you will be charged for the subscription. Only one free trial per Apple ID or Google account.

6. Growth Seeds & Future Self Garden

InnerSpace includes a Growth Seeds feature that tracks your daily engagement through a 7-day seed growth cycle. Completing an audio session or Sound Temple session each day unlocks the ability to water your seed and progress through growth stages. Reaching Day 7 allows you to manually save your completed tree to your personal garden.

You acknowledge that:

• Progress (seed stage, streak, tier, completed trees) is stored locally on your device by default. Unless you enable the optional Cloud Sync feature ("Save Across Devices"), InnerSpace Studio cannot recover this data if your device is lost, reset, or the app is deleted.
• The Growth Seeds system is a personal wellness tool and not a form of financial reward, competition, or ranking.
• InnerSpace Studio may adjust the rules, stages, tiers, or mechanics of the Growth Seeds system at any time through app updates.
• Any personal intention text you set for a seed cycle is private, stored only on your device, and is never transmitted to or accessible by InnerSpace Studio.

7. AI Features (Labs)

InnerSpace includes optional AI-powered features including "Untangle a Thought" journaling, Dream Reflection, and the AI Journey Creator, available to subscribers. When you use these features, the text you enter (including dream text you submit to Dream Reflection) is sent to Anthropic's Claude AI for processing. Messages are not permanently stored by us and are not used to train AI models. Use of all AI features is entirely opt-in.

AI-generated responses are provided for informational and wellness purposes only and do not constitute professional, medical, or psychological advice of any kind.

7a. Accounts & Cloud Sync

InnerSpace is fully usable without an account. You may optionally enable "Save Across Devices" to back up your data and link your account using Sign in with Apple or Sign in with Google.

• Linking an account is optional and can be done or undone at your choice. You are responsible for maintaining the security of the Apple or Google account you use to sign in.
• When Cloud Sync is enabled, your app data is backed up to secure servers under a private, per-user record. Details of what is stored and how are set out in our Privacy Policy.
• You may delete your account and all associated data at any time from Settings ("Delete Account"), which removes it from both your device and our servers.
• InnerSpace Studio provides Cloud Sync on a reasonable-efforts basis and is not liable for any loss of synced data arising from service interruptions, though we take reasonable measures to protect it.

8. Email Communications

InnerSpace offers an optional newsletter that you may subscribe to via the Settings page of the App or our website. By subscribing, you consent to receive periodic emails from us including wellness tips, app updates, and news about InnerSpace.

• Subscription is entirely voluntary and separate from your use of the App.
• You may unsubscribe at any time using the unsubscribe link included in every email, or by contacting us at hello@inner-space-studio.org.
• We will not share your email address with third parties for marketing purposes.

9. Feedback & Reviews

InnerSpace may invite you to submit voluntary feedback including a star rating and written comments. By submitting feedback you grant InnerSpace Studio a non-exclusive, royalty-free licence to use that feedback to improve the App and its services. Feedback submissions are handled by a third-party form processor (Formspree) and are subject to their terms and privacy policy.

10. Apple Health Integration

InnerSpace optionally integrates with Apple HealthKit on iOS. Both the read and write integrations are separate, opt-in permissions you control.

By enabling HealthKit access, you acknowledge that:

• InnerSpace can read your sleep (Sleep Analysis) and heart rate variability data solely to personalise session recommendations. These reads are processed locally on your device only and are never transmitted to InnerSpace Studio's servers or any third party.
• If you enable Mindful Minutes logging, InnerSpace writes the time window of your completed sessions to Apple Health's Mindful Sessions. It writes only Mindful Session entries and modifies no other Health data.
• You can change or revoke either permission at any time in your iPhone Settings → Privacy & Security → Health → InnerSpace.

InnerSpace's use of Apple Health data complies with Apple's HealthKit guidelines and is limited strictly to the in-app functionality described above. Health data is never used for advertising, analytics, or any purpose beyond direct feature operation.

11. Corporate Wellness (B2B) Licences

InnerSpace offers a corporate wellness licence that provides Premium access to InnerSpace for employees of an organisation. By entering into a B2B licence arrangement with InnerSpace Studio:

• The licence is granted to the contracting organisation and covers the agreed number of employee seats for the agreed billing period.
• Each employee uses InnerSpace for personal, non-commercial wellness purposes only. Employees may not redistribute, share, or sublicence access to any other person.
• The contracting organisation is responsible for ensuring employees use the App in accordance with these Terms.
• B2B licences are billed directly to the organisation. Pricing, billing frequency, and seat counts are agreed at the time of contracting and are subject to change with reasonable notice.
• Anonymised usage reports (sessions completed, active users, streaks) may be provided to the contracting organisation. No individually identifiable employee data is shared.
• B2B licences do not grant the right to play InnerSpace audio in shared spaces, publicly, or to persons outside the licensed employee cohort. For venue and public performance use, a separate Venue Licence is required.

12. Venue Licence & Public Performance Rights

By entering into a Venue Licence with InnerSpace Studio:

• Scope: The licence covers playback of InnerSpace original audio content within the licensed venue location(s) only. Playing content at unlicensed locations requires a separate licence per location.
• Public performance rights: InnerSpace Studio grants the licence holder a non-exclusive, non-transferable right to publicly perform InnerSpace original audio content within the licensed venue for commercial wellness purposes (e.g. during yoga classes, massage treatments, spa sessions, float tank sessions, breathwork sessions, and similar). This grant covers InnerSpace original content only.
• Third-party content: The Venue Licence does not cover any third-party music or content you may play through other apps or services. You remain responsible for obtaining appropriate licences (e.g. APRA/AMCOS in Australia) for any non-InnerSpace content.
• No redistribution: You may not record, rebroadcast, stream online, or redistribute InnerSpace audio content in any form. The licence covers in-venue atmospheric playback only.
• Billing: Venue Licences are billed per location per month. Continued use of InnerSpace content in a commercial venue without an active Venue Licence constitutes a breach of these Terms and may result in legal action.
• Cancellation: You may cancel your Venue Licence at any time. Upon cancellation, the right to play InnerSpace content commercially ceases immediately.

13. Health Disclaimer

InnerSpace is designed for relaxation, focus, and general personal wellbeing. It is not a medical product and is not intended to diagnose, treat, cure, or prevent any medical or mental health condition. If you have a medical or mental health condition, consult a qualified healthcare professional before use.

14. Limitation of Liability

To the fullest extent permitted by applicable law, InnerSpace Studio shall not be liable for any indirect, incidental, special, exemplary, or consequential damages arising from your use of the App, including but not limited to loss of data, loss of profits, or personal injury.

The App is provided "as is" without warranty of any kind, express or implied. InnerSpace Studio does not warrant that the App will be error-free, uninterrupted, or free of harmful components.

15. Termination

InnerSpace Studio reserves the right to suspend or terminate your access to the App at any time, with or without notice, if you breach these Terms or engage in conduct we determine to be harmful to other users, third parties, or the App itself.

16. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Australia.

17. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated date. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
